Terms of Service

These Terms govern access to DeskPilot's websites, demonstrations, dashboards, APIs, AI receptionists, and related services. By using the service, you agree to these Terms.

1. Eligibility and authority

You must be at least 18 and able to form a binding contract. If you use DeskPilot for an organization, you represent that you have authority to accept these Terms for that organization.

2. The service

DeskPilot provides AI-assisted telephone reception, lead intake, scheduling support, business knowledge responses, call summaries, dashboards, and related integrations. Features may change as the service develops. AI output can be incomplete or incorrect and must not be treated as legal, medical, financial, emergency, or other professional advice.

DeskPilot is not an emergency service. Customers must maintain appropriate human escalation and emergency procedures.

3. Accounts and security

You are responsible for accurate account information, safeguarding credentials, limiting authorized users, and promptly reporting suspected compromise. You are responsible for activity performed through your account unless caused by DeskPilot's breach of these Terms.

4. Telephone, AI, and recording compliance

Customers are responsible for determining which telephone, telemarketing, artificial-voice, do-not-call, call-recording, accessibility, privacy, and industry-specific laws apply to their use. Customers must obtain all required consent, honor opt-outs, configure permitted calling hours, and provide required AI and recording disclosures.

A person submitting the demo form expressly requests one AI-assisted demonstration call at the number provided, represents that they are authorized to receive a call at that number, and understands that the call may be transcribed or recorded after an appropriate disclosure. Consent to a demo call is not consent to unrelated marketing calls.

5. Acceptable use

You may not use DeskPilot to:

  • Break the law, impersonate others, deceive, harass, or defraud.
  • Place unsolicited or unauthorized automated calls.
  • Collect sensitive information without authority and safeguards.
  • Interfere with the service or bypass security and rate limits.
  • Upload malware or content that infringes another person's rights.
  • Use AI output as the sole basis for a high-impact decision.

6. Customer content and instructions

You retain ownership of business information, prompts, documents, and other content you provide. You grant DeskPilot the limited rights needed to host, process, transmit, reproduce, and transform that content to provide and secure the service. You represent that you have the rights and permissions necessary for us to process it.

7. Fees and subscriptions

Paid plans, usage limits, overages, renewal periods, and cancellation terms are presented at checkout or in an order form. Unless stated otherwise, subscriptions renew automatically until canceled. Applicable fees and taxes are non-refundable except where required by law or expressly stated in writing.

8. Third-party services

DeskPilot depends on third-party telecommunications, AI, cloud, email, payment, and integration providers. Their availability and terms may affect the service. DeskPilot is not responsible for third-party services outside its reasonable control.

9. Intellectual property

DeskPilot and its software, design, documentation, branding, and service technology are protected by intellectual-property laws. Except for the limited right to use the service under these Terms, no rights are transferred to you.

10. Suspension and termination

We may suspend or restrict access to protect the service, prevent unlawful or abusive activity, address nonpayment, or investigate a security risk. Either party may terminate as permitted by the applicable plan or order form. Provisions that by their nature should survive termination will survive.

11. Disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted service or that AI-generated responses will always be accurate.

12. Limitation of liability

To the fullest extent permitted by law, DeskPilot will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities. DeskPilot's aggregate liability arising from the service will not exceed the amount paid for the service during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law.
